Major Legal Win for Noem—What It Means for America?

For weeks, legacy media has tried to convince their dwindling audience that Trump officials are defying court orders and breaking the law. This narrative gained traction back in March according to Politico, when Judge James Boasberg, an Obama appointee infamous for authorizing FISA court surveillance of Trump's 2016 campaign, issued a shocking order. He demanded deportation planes, carrying Tren de Aragua gang members to El Salvador, turn around mid-flight as reported by Axios. Incredibly, Boasberg, who was silent as thousands entered the U.S. during Biden's tenure, wanted these gang members returned, making our southern border a "Hotel California" for leftist judges coverage noting.

 

Enter Kristi Noem. Homeland Security Secretary Noem instructed pilots to ignore Boasberg's order. The planes continued their journey, leaving Boasberg and Democrat media crying "contempt of court!" However, the DOJ found Noem did nothing wrong. Boasberg's ruling was oral, lacking the force of a binding injunction. By the time his written order materialized, those planes had landed in El Salvador, rendering them beyond U.S. jurisdiction according to NBC News.

 

Despite this, Boasberg filed contempt charges against Noem. But the D.C. Circuit Court of Appeals has now ruled on the DOJ's dismissal of his verbal instructions and the contempt charges. Prepare to be amazed! as reported by ABC News.

 

In August, a three-judge panel on the D.C. Circuit Court of Appeals dismissed Boasberg's contempt ruling by a 2-1 vote. Two Trump-appointed judges sided with the administration, declaring Boasberg's order too vague for contempt proceedings. One judge compared Boasberg's mid-flight plane turnaround demand to a 1973 order stopping U.S. bombing in Cambodia, which was swiftly overturned by the Supreme Court. Any such judicial order, they said, would improperly place unelected judges above the executive on matters of national security.

 

Recently, the full appeals court refused to reinstate Boasberg's contempt finding. The lack of a clear, binding written order at the time of the alleged violation meant no legal standard for contempt was met—a distinction the appeals court upheld. That's two losses in a row for this activist judge.

 

The legacy media, predictably ignoring this victory, has overlooked the broader picture. Since Trump's inauguration, activist groups have filed over 160 lawsuits, securing more injunctions in weeks than Biden faced in his entire term. Yet, Pam Bondi and the DOJ boast a remarkable win rate in appeals, triumphing in over 90% of Supreme Court cases. The Trump administration's success contrasts starkly with Biden's dismal record, where less than half of his cases won before SCOTUS. Justice Kavanaugh, for instance, has favored Trump 90% of the time compared to 40% for Biden—a 50-point gap!

 

While the media lauds the Biden administration as democracy's defender, Kristi Noem stands firm. She has repeatedly asserted to Boasberg and activist judges that they do not control immigration policy—the executive branch does.
