Texas Governor Greg Abbott launched a full-scale investigation involving twelve state agencies, which resulted in a cease-and-desist order after discovering EPIC had been operating an unlicensed funeral home on the premises. Attorney General Ken Paxton filed a civil investigative demand, and Senator John Cornyn called on the DOJ to investigate. HUD launched a Fair Housing Act investigation because selling homes exclusively to members of one religion is obviously a federal civil rights violation.

 

However, in June 2025, the Department of Justice closed its federal civil rights investigation, with Community Capital Partners affirming that the development would be open to everyone regardless of faith, satisfying their Fair Housing Act obligations. EPIC City supporters celebrated this as a vindication. Then, in April 2026, a Travis County judge sided with the developers, ordering the Texas Workforce Commission to process EPIC's fair housing paperwork. Ken Paxton's office immediately appealed and got the ruling frozen at the Fifteenth Court of Appeals. As things stand, EPIC City is still not built, and construction remains blocked as of now. But Texans aren't waiting around on the courts or politicians; they’re taking things into their own hands in ways no one ever imagined!

 

In March, Texas Republican primary voters faced a ballot question—Proposition 10—asking whether the state should ban Sharia law from being used in any Texas court or government proceeding. The result? An astounding 94.8 percent of Republican primary voters voted YES. In a state of 30 million people, from Amarillo to Corpus Christi, from El Paso to Beaumont, the verdict of the Texas electorate was delivered with clarity and finality. This is American soil. American law applies here. Period. End of discussion.

 

What we're witnessing in Texas is a live test case for how far organizations can go in building parallel, insular communities under the banner of religious liberty while dodging the same transparency and accountability every other developer in America must follow. Texas House Bill 4211, passed in 2025, now explicitly bans any residential development from restricting home sales based on religion. That law exists because of EPIC City. Whatever you think about the mosque's ultimate intentions, that alone tells you lawmakers saw a real gap that needed closing.
