The lawsuit is based on the invocation of the 14th Amendment, which prevents individuals who have taken an oath to uphold the Constitution but have later been involved in acts of insurrection against the nation from holding office. This strategy has been employed in other states like California, Colorado, and Minnesota, reflecting a trend of legal actions against Trump and his supporters.

KOAT Legal Expert John Day noted that a similar 14th Amendment argument resulted in the removal of Otero County Commissioner Couy Griffin from his position in New Mexico, adding to the perception among Trump’s followers that these legal actions are politically motivated.
Castro’s legal actions extend beyond New Mexico, with additional federal cases filed in various states, all with the goal of challenging Donald Trump’s eligibility in the 2024 presidential election.
However, amid a decision from the U.S. Supreme Court, every state that has attempted to deny the American people the right to vote for Donald Trump’s re-election will not be granted the ability to do so.

Unfortunately, this victory doesn’t signify an end to the relentless pursuit by the Department of Justice. New York City District Attorney Leticia James stands as one cog in a machine that appears unyielding in its use of a corrupted interpretation of the law to target her political adversaries—an approach she openly championed during her campaign.

As one political witch hunt ends, it’s crucial to unite behind the candidate evidently being targeted. President Trump remains the most politically persecuted president in American history; however, he is also the only one positioned to address the corrupt environment that fueled these deceitful attacks.
